Terms and conditions for prints and digital series
Draft – please have it reviewed before publishing.
As of October 2026
§ 1 Scope
(1) These terms apply to all orders placed via atelier207.art. The seller is Harald Gruber, Studio 207 Fotografie & Grafik-Design, Hofkirchen 207, 84082 Laberweinting, Germany, email: hello@atelier207.art (“we”).
(2) We offer fine art prints in limited editions (“prints”) and digital image series for download (“digital series”).
(3) Our offer is directed exclusively at adults.
§ 2 Conclusion of contract
(1) The presentation of works on the website is not a binding offer but an invitation to order.
(2) By clicking “Order with obligation to pay” you submit a binding offer. You will first receive an automatic acknowledgement of receipt, which is not yet an acceptance.
(3) The contract is concluded when we confirm your order by email (order confirmation with payment details). For works marked “price on request”, your request is non-binding; the contract is only concluded once you accept our offer.
(4) We store the contract text and send it to you with the order confirmation. The contract languages are German and English.
§ 3 Limitation and numbering
(1) The stated edition size applies to all sizes of an image combined. Once reached, the image will not be printed again.
(2) Copy numbers are assigned in order of orders and stated in the order confirmation. There is no entitlement to a specific number.
§ 4 Prices, shipping and payment
(1) All prices are final prices including statutory VAT. For prints, the shipping costs shown before you submit your order are added.
(2) Payment is by bank transfer within 7 days of the order confirmation. If payment is not received in time, we may withdraw from the contract and release the copy again.
(3) Deliveries to countries outside the EU may incur customs duties, taxes and fees, which are borne by the recipient.
§ 5 Delivery
(1) Prints are made, inspected, signed and shipped insured with DHL after payment. Delivery usually takes 1–2 weeks from receipt of payment plus the carrier’s transit time.
(2) Digital series are provided after payment via a personal download link, valid for 14 days and limited to a number of downloads; on request we provide a new link.
(3) Goods remain our property until paid in full.
§ 6 Rights of use
(1) Buying a print gives you ownership of the physical copy. Copyright and rights of use in the image remain with the author. Reproduction and publication are not permitted.
(2) For digital series you receive a simple, non-transferable right of use exclusively for private, personal use. Passing on, publishing (including on social media), editing for publication and any commercial use are prohibited.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Details, in particular on early expiry for digital content, are set out in the withdrawal policy.
§ 8 Transport damage and warranty
(1) If prints arrive with obvious transport damage, please report this to the carrier as soon as possible and contact us. Your statutory rights remain unaffected.
(2) Statutory warranty rights apply. Slight deviations in colour and tone between screen and print are due to the material and do not constitute a defect.
§ 9 Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable, typical damage.
§ 10 Final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protection of the country of their habitual residence.
(2) We are neither obliged nor willing to participate in consumer dispute resolution proceedings.
(3) Should individual provisions be invalid, the validity of the remaining provisions shall not be affected.
(4) In case of doubt, the German version of these terms prevails.
